These Terms of Service ("Terms") are an agreement between you and EatNOM Inc. DBA NOM Media ("NOM Media," "we," "us," or "our"). They apply when you use nommedia.co, submit a form, book a call, chat with us, or receive email or text messages from us. By using our website or services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.
1. Who may use this site
You must be at least 18 years old to use this site, submit forms, or book calls. If you use the site on behalf of a company or organization, you confirm that you are authorized to accept these Terms for it.
2. Using the website
You may use the site to learn about our services, read our journal, and contact us. You agree not to:
- Use the site for any unlawful, fraudulent, or harmful purpose
- Submit false information, impersonate anyone, or submit someone else's contact details without permission
- Send spam, malware, or automated submissions through our forms, chat, or booking tools
- Attempt to access systems or data you are not authorized to access, or disrupt the site
- Scrape, copy, or republish our content at scale, except that search engines and AI assistants may index and cite our public pages as permitted by our robots.txt file
3. Our content and trademarks
The content on this site, including text, guides, graphics, logos, photographs, video, and design, is owned by NOM Media or our licensors and is protected by copyright and trademark law. You may view, share links to, and quote short excerpts of our content with attribution and a link back. You may not otherwise copy, modify, sell, or republish it without our written permission. "NOM Media," "NOM Studios," and our logos are our trademarks. Client names and logos shown on the site belong to their owners and appear to describe our work.
4. Information you send us
You are responsible for the information you submit through our forms, chat, booking pages, and messages, and you confirm that it is accurate and that you have the right to share it. Please do not send confidential information, passwords, or sensitive personal information through website forms or chat. Ideas or feedback you send us may be used by us without obligation to you, unless we agree otherwise in writing.
5. Strategy calls and bookings
Strategy calls are free, typically 30 minutes, and held by video unless we agree otherwise. Booking a call does not create a client relationship, contract, or obligation for either party. Any recommendations shared on a call are general and preliminary. Please reschedule or cancel at least 4 hours in advance using the link in your confirmation. We may decline or reschedule calls at our discretion.
6. Paid services
Paid work begins only after both parties sign a written proposal, statement of work, or agreement. That document governs the scope, fees, deposits, timelines, ownership of deliverables, and other terms of the engagement. If it conflicts with these Terms, the signed agreement controls. Unless that agreement says otherwise, a deposit is required before work begins, and final files are released once payment is received.
7. Text message and email program
By checking the consent box on our forms or booking pages, you agree to receive recurring automated text messages and emails from NOM Media at the phone number and email you provided, including appointment confirmations, reminders, follow ups, and occasional marketing messages. Consent is not a condition of purchase.

- Privacy: mobile numbers and text messaging consent are never shared with third parties for their marketing. See our Privacy Policy.
If you change or deactivate your phone number, please tell us so messages do not reach the wrong person.
8. Chat and AI assistants
Our chat, phone, and messaging channels may use an AI assistant to answer common questions and book calls. AI responses are provided for convenience, may occasionally be inaccurate, and are not a binding offer, quote, or commitment. Pricing, scope, and terms are confirmed only by a person from our team in writing.
9. Third party tools and links
We use third party services for scheduling, forms, video meetings, messaging, and payments, and our site links to other websites. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third party websites or services.
10. No guarantee of results
Marketing outcomes, including search rankings, AI search visibility, traffic, leads, and sales, depend on many factors outside our control, such as search engine and platform changes, competition, budgets, and market conditions. We do not guarantee any specific result. Statistics and figures on this site describe past or aggregate results and are not a promise of future performance. Content in our journal is general information, not legal, financial, tax, or medical advice.
11. Disclaimers
The site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non infringement. We do not warrant that the site will be uninterrupted, error free, or free of harmful components.
12. Limitation of liability
To the fullest extent permitted by law, NOM Media and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the site, our free consultations, or our messages. Our total liability for any claim related to the site or these Terms will not exceed one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Indemnification
You agree to defend and indemnify NOM Media against claims, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the site, your violation of these Terms, or information you submit that you did not have the right to share.
14. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Before filing any claim, you agree to contact us at theo@nommedia.co and try to resolve the issue informally for at least 30 days. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in Nassau County, New York, and you consent to their jurisdiction.
15. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms, and we may assign ours in connection with a business transfer. These Terms, together with our Privacy Policy and any signed agreement with you, are the entire agreement about the site.
16. Changes to these Terms
We may update these Terms from time to time. The date at the top shows the latest version. Continuing to use the site after changes are posted means you accept the updated Terms.
